1. Purpose
These Terms and Conditions of Sale govern, on the part of Stéphanie Borla, Entreprise Individuelle, SIRET 809 836 620 00017, 25 avenue Vincent Negrel, 83740 La Cadière d'Azur (hereinafter "the Seller"), for the benefit of any natural or legal person (hereinafter "the Client"), via the site aria-imperium.com:
, on the one hand, the sale of the Impérium digital product, governed by articles 2 to 13 below;
, and on the other hand, the sale of the services offered by the Seller (turnkey installation, group workshops, one-to-one coaching), governed by articles 14 to 19 below.
Articles 11 to 13 (personal data, applicable law and mediation, legal guarantees) apply equally to the product and to the services.
Any order implies full and complete acceptance of these Terms.
2. Description of the product
Impérium is a complete digital system comprising a sales funnel, a member area and marketing automation, delivered as a source code repository to be installed by the Client. The product includes an individual licence of use, access to the code, and the built-in Aria assistant (which requires a third-party Claude Pro subscription, not included).
3. Price
The price of the product is shown in euros on the sales page at the time of the order. The Seller falls under the French small business VAT exemption (article 293 B of the General Tax Code): the prices shown contain no VAT, and none is charged. The price may be changed at any time, but the price applied is the one displayed when the Client confirms the order.
4. Payment
Payment is made online by bank card through the secure Stripe platform. The Seller stores no banking data.
5. Delivery
Delivery is digital and takes place immediately after payment is confirmed: the Client receives by email a login link to their members area and their licence key. The product can be downloaded from the members area.
6. Right of withdrawal
In accordance with article L221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for the supply of digital content not provided on a tangible medium where performance has begun after the consumer's prior express agreement and express waiver of that right.
By confirming the order, the Client expressly acknowledges waiving their right of withdrawal as soon as they access the digital content delivered.
7. Satisfaction or money-back guarantee
The Seller offers, on a commercial basis and independently of the right of withdrawal, a refund guarantee of 7 days from the date of purchase. This commercial guarantee covers the Imperium digital product alone; it does not apply to the services referred to in article 14 and following, which fall under the withdrawal regime specific to services described in article 17.
To exercise this guarantee, the Client sends an email to contact@aria-imperium.com with the address used for the purchase. The refund is made within 14 days using the same means of payment as the one used for the order.
After a refund, access to the product is revoked.
8. Licence of use
The Client is granted a personal, non-exclusive and non-transferable licence to use the Impérium product. Reselling, redistributing or publicly making the code available to third parties is strictly prohibited.
9. Support
The Seller undertakes to answer the Client's questions by email at contact@aria-imperium.com within a reasonable time (generally within 48 working hours). Primary technical assistance is provided by Aria, built into the product.
10. Liability
The Seller undertakes to supply a product conforming to its description. The Seller cannot be held liable for indirect damage resulting from the use or the impossibility of using the product, nor for failures of third-party services (Stripe, Supabase, Resend, Netlify, Claude).
11. Personal data
The processing of the Client's personal data is set out in the Privacy Policy.
12. Applicable law and mediation
These Terms are subject to French law. In the event of a dispute, the Client may, before any legal action, use a consumer mediator free of charge in accordance with article L612-1 of the French Consumer Code.

13. Legal guarantees
Independently of the commercial guarantee provided for in article 7, a Client who is a consumer benefits from the statutory guarantees applicable to digital content and services: the legal guarantee of conformity (articles L224-25-1 and following of the French Consumer Code) and the guarantee against hidden defects (articles 1641 and following of the French Civil Code).
On that basis, the Client may obtain the bringing of the digital content into conformity or, failing that, a price reduction or a refund, under the conditions and within the time limits laid down by law. Any request should be sent to contact@aria-imperium.com.
14. Services offered
Independently of the sale of the product, the Seller offers the following services, carried out personally by the Seller:
, Impérium turnkey: installation, publication and personalisation of the system in the Client's place, based on the material the Client provides;
, Group workshops concerning the construction of the Client's offer and positioning, by video call;
, One-to-one coaching covering the Client's own situation, by video call.
These services are distinct from the Impérium digital product. They do not replace it and are not included in its price.
15. Price, quotation and scope of the services
The price of the « turnkey Imperium » service is 1,490 €, in addition to the price of the digital product. Coaching services are subject to an individual quotation. As with the product, the prices of services contain no VAT (small business exemption, article 293 B of the General Tax Code): the amount announced is the amount due.
Every service gives rise to a written quotation in advance, given to the Client before any commitment. This quotation states: the nature of the service, its exact scope, the expected deliverables, the number of sessions or modules included, the number of revision rounds included, the provisional schedule and the price.
In the event of any discrepancy between the quotation and these Terms as to scope, schedule or price, the quotation prevails. Any request from the Client going beyond the scope of the quotation is subject to a written amendment and, where applicable, to an additional price accepted before performance.
The Seller deliberately limits the number of « turnkey » services accepted each month. The Seller may therefore propose a later delivery date, and the Client may not rely on this as a ground for claim.
16. Order, performance and the Client's obligations
An order for a service is formed by the Client's written acceptance of the quotation, by email or by signature. Payment is made according to the terms set out in the quotation.
Performance requires the Client's active cooperation. The Client undertakes to supply, within the agreed timescales, the items needed for the service: texts, images, videos, information about the offer, together with access to the required third-party services (domain name, payment, email sending and hosting accounts).
If these elements are not supplied, the performance deadlines are suspended accordingly, without the Seller's liability being engaged. If the Client remains unresponsive for more than sixty days despite two written reminders, the service is deemed performed for the part already carried out, and the corresponding sums remain acquired by the Seller.
The Client warrants that they hold the rights to all the material they send and remains solely responsible for its content, in particular for the claims it contains.
17. Right of withdrawal applicable to services
The consumer Client has a period of fourteen days from acceptance of the quotation to withdraw, without having to give reasons, in accordance with article L221-18 of the French Consumer Code. This right is exercised using the form set out in article 20 or by any unambiguous statement sent to contact@aria-imperium.com.
Early performance. If the Client wishes the service to begin before that period expires, they make an express request to that effect, in accordance with article L221-25 of the same code. In the event of subsequent withdrawal, the Client remains liable for an amount proportionate to what has actually been supplied up to the moment their decision is communicated, in relation to the total agreed price.
Loss of the right of withdrawal. In accordance with article L221-28 1° of the French Consumer Code, the right of withdrawal can no longer be exercised for services fully performed before the end of the fourteen-day period, where performance began after the Client's prior express agreement and express acknowledgement of the loss of that right.
Professional Client. The right of withdrawal also benefits the professional Client employing five staff or fewer, where the subject of the service falls outside the scope of their main activity, in accordance with article L221-3 of the French Consumer Code. It does not apply to other professional Clients.
18. Postponement, cancellation and absence
Coaching and workshop sessions. Any session may be rescheduled free of charge where the request is made at least forty-eight hours before the agreed time. Within that period, or if the Client is absent, the session is deemed due and deducted from the service. If the Seller is prevented from attending, the session is rescheduled to a date agreed with the Client, at no cost and without deduction.
Group workshops. The Seller may postpone a session where the minimum number of participants stated in the quotation is not reached. The Client is informed before the planned date and may then choose between postponement and full refund of the sums paid.
Cancellation by the Client after the withdrawal period. The sums corresponding to services already performed remain acquired by the Seller. Any balance is refunded within fourteen days.
19. Deliverables, ownership and liability for services
The deliverables produced under a service, pages, texts, settings, formatted content, belong to the Client as soon as they are paid for in full. The Seller retains no exclusive right of use over them. The licence covering the Impérium product itself remains governed by article 8.
The Seller is bound by an obligation of means. The Seller undertakes to perform the service with care and in accordance with the quotation, but guarantees no commercial result: no turnover, no number of clients, no ranking in search engines or recommendation systems. No revenue projection is made or guaranteed.
The Seller's liability for a service cannot exceed the amount actually paid by the Client for it. It cannot be engaged for indirect damage, nor for failures of third-party services (Stripe, Supabase, Resend, Netlify, Claude, hosting provider or domain name registrar).
20. Model withdrawal form
As regards the digital product, the right of withdrawal does not apply where performance began with the Client's express agreement and waiver (see article 6). As regards the services, it is exercised under the conditions of article 17, using the form below, reproduced in accordance with the annex to article R221-1 of the French Consumer Code:
